INTRODUCTION

 
On On February 24, 2016, the US won a ruling against India at the World Trade Organization (WTO), the global trade body, after it challenged the rules on the origin of solar modules and solar cells used in the Jawaharlal Nehru National Solar Mission (JNNSM) – the national solar power program in India. After giving its ruling, the WTO in a panel report stated, “The DCR measures are inconsistent with Article 2.1 of the TRIMs (Trade-Related Investment Measures) Agreement and Article III:4 of the GATT 1994, and are not covered by the derogation in Article III:8(a) of the GATT 1994; and are not justified under the general exceptions in Article XX(j) or Article XX(d) of the GATT 1994.” The US Trade Representative’s office termed the ruling as a crucial victory that would speed up the process of providing solar energy across the world and also support solar-energy jobs in the US...
